just brought 318si 1999 and the wobble in the wheel has been confirmed as disc warping. this car only past its MOT a month ago ? should i expect the garage to pay for the repairs ?

At the time of the MOT the tester would've not been able to visually suspect a warped disc. Yes he may have noticed some slight "catching" of the pads-to-disc but could've put that down to "pad-float"...

An MOT station will not carry out repairs without the owners permission and cannot repair at the time of MOT test (some will make minor adjustments for you).
