I have read about 5 series having swirl flap issues but not the E53 that doesn't mean they aren't there.

Not a Diesel driver but I would be looking at www.realoem.com put the last 7 digits of your Vin into the search box it will bring up your model then check the parts listed 

Also check www.newtis.info This one is a BMW technical information site if there are swirl flaps they will be mentioned there in the service information if you have them. Just had a quick look at the E53 3.0D section typed in swirl flaps and a lot of stuff came up so it looks like you may have them.
