730D 2003 Transmission Faults

My 730d has 2 transmission faults and I'm not sure if they're related:

1. When starting from cold, my car will "shutdown" normally within minutes of leaving home - the "transmission failsafe" warning flashes, and the car goes into limp mode. It is easily rectified by switching on/off (sometimes more than once), but is nonetheless very annoying. It started probably 2 years ago (once in a blue moon), but now happens virtually every morning.
   
2. The car will not change up under heavy acceleration. When I boot it, the kickdown changes DOWN, but it then screams up to max. rev's and does not change UP. In order to get the transmission to change up, I have to take my foot off the accelerator. Meantime the Toyota Yaris in the inside lane has sped off into the distance, and the Transit van behind me is flashing me to move over. Again very annoying. During normal driving the gear changes are smooth and at the right rev's, and whilst accelerating from say 55-75mph it flies along.
   

As I said, I'm not sure if the 2 are related. I'm hoping someone may have come across one, or both of these faults, and possibly know of a simple fix. Given the age and Mileage (105k) of the car, I don't want to spend £hundreds investigating, only to be told it will cost £thousands to fix.

Has the Tranny Fluid been changed?

Its probably a computer error.

Needs reprogramming IMO

Gav - thanks for that. If that is the case, is it a job for a main dealer, or are there specialists out there (in the East Midlands)??

Dabsy - thanks for that. I've checked the fluid and it's full AND appears to be very clean (nice and clear with a red tinge to it).
